How do the City and HOAs interact?

Did you know that Brooklyn Park has over 120 Homeowners Associations (HOAs) that contain almost 40% of our single-family properties?

HOAs are self-governed, private entities. Properties within HOAs must follow local ordinances. They can also have bylaws and covenants that are stricter than city code. HOAs are responsible for enforcing these rules via associations, management companies, and local board representatives. The City of Brooklyn Park cannot enforce them for HOA residents. The city depends on HOAs to help created a united and welcoming committee.

What are my rights as a resident living in an HOA?

The Department of Commerce oversees property management companies. HOAs are subject to the federal Fair Housing Act. If an HOA discriminates against a homeowner based on a protected class, you can submit a complaint to the MN Departments of Human Rights or Housing and Urban Development.

What can the city do to assist me with my HOA?

The City aims to inform and connect HOAs with several strategies and resources, including:

  • Semi-annual HOA workshops
  • Collecting HOA board member contact information
  • Answering resident questions and sharing information
  • Providing welcome bags to share with new neighbors in your HOA
  • Funding community building activities with the Neighborhood Activity Fund
  • Providing Housing Improvement (HIA) Loans
  • Organizing crime prevention meetings to offer tips and address concerns

Report an HOA issue

If you are experiencing an issue with your HOA, you should first report it either to your property management company or board of directors. If your issue has not been resolved, then The City of Brooklyn Park may be able to help connect you with resources depending on your issue. If the issue is not resolved, you should report it to the state Departments of Human Rights or Housing and Urban Development.
