Grading Ground Rules:
Filling/Stockpiling/Digging Permits
- Less than 200 cubic yards - No Permit Required - (25 Tandem Truck Loads)
- From 200 to 1,000 cubic yards - Per Ordinance 118.01, need City Engineer approval
- From 1,000 to 20,000 cubic yards - Per Ordinance 118.01, need City Council approval
- Over 20,000 cubic yards - C.U.P. Process - Ordinance 152.242
Exceptions:
- Approved Building Permit
- Approved Preliminary Plat with sureties posted
- Approved C.U.P./P.U.D. with sureties posted
- Approved Highway/Street construction project
Note: The disposal of any materials by burying is prohibited within the city limits except by special license.
Section 420:10. Prohibition. No person shall cause or permit any garbage, tin cans, paper, ashes, junk, or other trash or refuse of any kind to be dumped, thrown, scattered, or deposited on any land within the corporate limits of this municipality not licensed as a public dump or sanitary landfill operation. Every person who shall have dumped, thrown, scattered, or deposited any garbage, tin cans, paper, ashes, junk or other trash or refuse of any kind upon any land within the corporate limits of this municipality not duly licensed shall immediately remove the same; each day that he shall fail to remove said items shall be deemed a separate offense.
Section 420:15. License Required. It shall be unlawful for any person, firm, association, or corporation; or any combination or combinations of the same, to use any land, premises, or property for a dump or sanitary landfill without first making application for and securing a license to do so.
