Driveway Permit Guidelines:

 


When is a permit required?


Driveway permits are required when a resident or contractor is proposing work that alters in any way the existing curb and gutter.  For example, a resident wants to remove a steep curb and gutter and replace it with a driveway apron of lesser slope, or wants to saw off the top of the existing sloped curb leaving the gutter intact.  A permit is also required if the resident or contractor wants to simply remove and replace the existing curb and gutter.


How wide can my driveway be paved?


Within City of Brooklyn Park right of way (ROW), which is typically the first 14 feet from the back of the curb towards your house, it depends on the type of curb and gutter in the street and varies between 25 feet and 30 feet.  If you have Type BP 412, which is a 3:1 sloped curb and gutter, the maximum width within the ROW is 30 feet.  This type of curb is typical in the newer developed areas.  If you have Type B618 curb, which has a 6 inch high straight back and 18 inch wide gutter section, the width can be a maximum of 25 feet within Brooklyn Park ROW.

The MINIMUM width for a driveway is 12 feet within Brooklyn Park ROW.

Outside of City of Brooklyn Park ROW, you may have any width of driveway as long as it conforms to the standards below.


How close to my property line can the driveway be located?


You must remain at least 5 feet away from your side property line, and 38 feet from any intersecting street if your property is on a corner lot.


What is the permit fee?


$25.00
